AMONG OTHER ACTIVITIES, MEVO HEALTH’S SERVICES ENABLE COORDINATION AND COMMUNICATION WITH A HEALTH CARE PROVIDER. THEY DO NOT REPLACE YOUR RELATIONSHIP WITH ANY PHYSICIAN. THESE SERVICES MIGHT NOT BE APPROPRIATE FOR ALL MEDICAL CONDITIONS OR CONCERNS. IF YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR DOCTOR OR DIAL 911.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BECAUSE THEY SET FORTH IMPORTANT TERMS YOU NEED TO KNOW ABOUT THE SERVICES. BY ACCESSING OR USING THE SITES OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE LEGALLY BOUND BY AND COMPLY WITH THESE TERMS OF USE. IF YOU DO NOT OR CANNOT AGREE WITH ANY PART OF THESE TERMS OF USE, YOU MAY NOT USE THE SITES OR ANY SERVICES PROVIDED ON OR THROUGH THEM.

THE TERMS OF USE ARE SUBJECT TO CHANGE AS PROVIDED HEREIN.

Introduction

Mevo Health LLC, and its affiliates (“Mevo Health,” “we,” “us,” or “our”), own and operate the websites located at https://www.mevohealth.com and related mobile applications (collectively, the “Sites”).
The Sites are intended to facilitate the provision of the Services to registered users, which may include:

  1. Providing individuals with health and wellness information (“Content”).
  2. Providing pharmacy services.
  3. Providing access to digital health tools.
  4. Collecting, storing, and organizing health records and information for use in healthcare provider consultations and pharmacy services.
  5. Providing administrative support for scheduling, payments, and pharmacy fulfillment.
  6. Enabling telecommunications and technology support for virtual care, consultations, and treatment by independent healthcare professionals who utilize the Mevo Health platform.

These Terms of Use describe your rights and responsibilities regarding the Mevo Health Sites and Services. Your access to and use of the Sites is subject to these Terms, our Privacy Policy, and all applicable laws and regulations.

If you do not accept and agree to be bound by these Terms, you are not authorized to access or use the Sites or Services. The Sites and Services are continually under development, and Mevo Health reserves the right to update or revise these Terms of Use at any time without prior notice. Your continued use of the Sites or Services after changes are posted constitutes acceptance of those changes.

Availability

Certain Mevo Health Services may only be available to individuals located in specific states.

Eligibility

To use the Services, you must:

  • Be at least 18 years old.
  • Be located in a state where Mevo Health operates.
  • Agree to these Terms of Use.

Meeting these requirements does not guarantee that you will receive Services. Mevo Health reserves the right to modify eligibility requirements at any time without notice.

Requirements for Use

You must have compatible devices, internet access, and necessary software to use the Sites. Standard carrier and data fees may apply.

Special Consent to Telehealth Services

Telemedicine involves the delivery of healthcare using electronic communication when the patient and provider are in different locations. It may include:

  • Transmission of medical records, images, and personal health data.
  • Interactions via secure messaging, audio, or video.
  • Use of medical device outputs and other digital data.

Mevo Health employs security protocols to protect patient information and maintain data integrity.
Please refer to our Asynchronous Telemedicine Informed Consent for detailed information about the risks and benefits of telemedicine. That consent is incorporated herein by reference.

Privacy Policy

Mevo Health values your privacy and confidentiality. Please review our Privacy Policy for details on how we collect, use, and protect your information.

Your Relationship with Mevo Health

Mevo Health does not provide medical services. Rather, it provides a technology platform that enables you to connect with independent, licensed healthcare providers who deliver clinical services through the platform.
Decisions regarding diagnosis, treatment, or prescriptions rest solely with the healthcare provider.
By accepting these Terms, you consent to receive electronic communications (including notices, disclosures, and updates) from Mevo Health and its affiliates. It is your responsibility to review and act upon such communications.

HIPAA Compliance:

Mevo Health acts as a Business Associate to certain healthcare providers who deliver care through our platform. In this capacity, Mevo Health may store, transmit, or process protected health information (“PHI”) on behalf of those providers in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and applicable state privacy laws. Mevo Health maintains administrative, technical, and physical safeguards to protect PHI as required by law.

Communications by Text Message and Email

By opting in to receive text (SMS) messages or emails from Mevo Health, you consent to receive messages about your account, orders, appointments, and—if opted in—promotional updates.

You acknowledge and agree that:

  1. You are the authorized user of the provided contact number or email.
  2. Standard carrier and data rates may apply.
  3. Text and email communications are not encrypted and may be intercepted by third parties.
    You may opt out of SMS marketing at any time by replying “STOP.” For help, email care@mevohealth.com.

Consultative Services

Healthcare providers using the Mevo Health platform may not have access to all clinical information typically obtained during in-person visits. Therefore, you should provide complete medical history and discuss any concerns directly with your provider.
By using these Services, you acknowledge and accept the limitations of telehealth consultations and agree that:

  • Diagnoses or treatments may be limited or provisional.
  • Telehealth is not a substitute for in-person evaluation in all cases.
  • The absence of a physical examination may impact diagnostic accuracy.
Automated Tools and Decision Support:

Certain features of the Mevo Health platform may include automated systems designed to assist with triage, patient intake, or health recommendations. These tools are not a substitute for professional medical advice or clinical judgment. All diagnoses, prescriptions, and treatment decisions are made solely by licensed healthcare practitioners.

Registration and User Accounts

You may need to register for a Secure User account to access certain features.
You agree to:

  • Provide accurate and up-to-date information.
  • Maintain the confidentiality of your login credentials.
  • Notify Mevo Health immediately of any unauthorized use by emailing care@mevohealth.com.

You are responsible for all activity under your account. Mevo Health may suspend or terminate accounts that violate these Terms.

Access Rights and Prohibited Use

You are granted a limited, non-transferable license to access and use the Sites and Services for personal, non-commercial purposes.
You agree not to:

  • Use the Sites for any unlawful purpose.
  • Copy, modify, or distribute content without authorization.
  • Attempt to gain unauthorized access to systems or networks.
  • Interfere with or disrupt the operation of the Sites.

All rights not expressly granted remain with Mevo Health and its licensors.

Ownership of Submitted Information

Except for personal health data protected under our Privacy Policy, any information or suggestions you provide to Mevo Health via the Sites will be treated as non-confidential and may be used by Mevo Health for product improvement, analytics, and service enhancement.

Ownership of Site Content

All content, software, and functionality on the Sites are the exclusive property of Mevo Health and are protected by intellectual property laws. You may not reproduce, distribute, or modify any content without written permission.

Trademarks

All names, logos, and related marks are trademarks of Mevo Health or its affiliates. You are not authorized to use them without written consent.

Links to Third-Party Websites

Our Sites may contain links to third-party websites for convenience. Mevo Health is not responsible for their content, policies, or accuracy. Use of third-party sites is at your own risk.

Termination

You may discontinue use of the Sites at any time. Mevo Health reserves the right to suspend or terminate access without notice for violation of these Terms or other reasons. Upon termination, your right to use the Sites ceases immediately.

Disclaimer of Warranties

THE SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
MEVO HEALTH AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
MEVO HEALTH DOES NOT GUARANTEE THAT THE SITES WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEVO HEALTH AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES OR SERVICES.

Indemnification

You agree to indemnify and hold harmless Mevo Health, its affiliates, and their respective officers, directors, and employees from any claims, damages, or losses arising from your violation of these Terms or misuse of the Services.

Modifications to the Sites

Mevo Health may modify, suspend, or discontinue any part of the Sites or Services at any time without notice. We are not liable for any resulting unavailability.

Pharmacy Services

If you receive a prescription through Mevo Health, you may choose to have it filled by the Mevo Health Pharmacy Network or another licensed pharmacy of your choice. By using our pharmacy services, you consent to the sharing of necessary health information with the pharmacy for dispensing and fulfillment purposes.

Payment

You agree to pay all applicable fees for services requested. By submitting payment details, you authorize Mevo Health and its processors to charge the corresponding amount.
Payments may include provider or pharmacy fees collected on their behalf. If a payment fails, you may be asked to update your payment method to continue receiving services.

Special Notice to Medicare and Medicaid Beneficiaries

Federal and state healthcare programs generally do not cover services provided through Mevo Health’s telemedicine platform. By using our Services, you agree to pay privately for such services.

Program-Specific Terms

Certain Mevo Health programs, such as hormone health or weight management, may include additional terms and fees, which will be presented prior to enrollment.
You may cancel or delay participation at any time by emailing care@mevohealth.com.

Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Delaware.
Any disputes shall be resolved by binding arbitration in New York, New York, in accordance with the rules of the American Arbitration Association.

If any provision of these Terms is found invalid, the remaining provisions shall continue in effect.

No Waiver

Failure by Mevo Health to enforce any right under these Terms shall not be deemed a waiver of such right or any other.

Assignment

You may not assign these Terms or any rights hereunder without written consent. Mevo Health may assign these Terms in connection with a merger, sale, or reorganization.

Digital Millennium Copyright Act (DMCA)

If you believe your copyrighted work has been used on our Sites without authorization, please notify our designated agent at care@mevohealth.com with the following information:

  • Your contact details and electronic signature.
  • A description of the copyrighted work and where it appears on the Sites.
  • A good-faith statement that use of the material is unauthorized.
